Grounds for divorce in Kansas
Divorce is one of the more common family law matters. In Kansas, at least one spouse must be a resident of Kansas for a period of 60 days before filing for divorce. Kansas is a “mixed state” in terms of divorce, which means that the divorce can be based on either no-fault or fault grounds. If the couple is legally separated for a period of at least two years, that can also be used as grounds for divorce.

Kansas is an “equitable division state” in terms of divorce. What this means is that each spouse owns any income that he or she earned during the course of the marriage. That spouse also has the legal right to manage any property that is listed in their name alone. If that couple divorces, a judge will divide the marital property in an “equitable” manner – this is what the judge deems is fair, which may not be exactly equal.
