A Florida state court lawsuit involves Buzz Aldrin, who is suing his former business manager and two of his children alleging that they misused his credit cards by claiming that he has dementia and is not able to care for himself. His children filed a petition claiming that their father was suffering from delusions, confusion, paranoia and memory loss.
Therefore, the two children requested that the court name them as his legal guardians, saying that the assets spent by Aldrin were disappearing at an alarming rate. Mental health experts plan to evaluate Aldrin.
This situation highlights why it is so important to have clear documents in place for who is eligible to determine whether or not you have capacity to make your own financial decisions, and who is empowered to step into this role if you were to become incapacitated due to mental decline or an accident. Supporting yourself with the insight of an experienced estate planning attorney is critical.
